Terms of Service
The terms governing your use of the Wattmatch marketplace.
1. Who we are
Wattmatch operates a marketplace connecting commercial & industrial electricity buyers with renewable energy generators. Wattmatch acts solely as a facilitator and is not a party to, and never a principal in, any power purchase agreement executed between a buyer and a generator through the marketplace.
2. Eligibility & accuracy
By submitting information through this site, you confirm that the information you provide is accurate to the best of your knowledge and that you are authorised to act on behalf of the company you represent.
3. No guarantee of match or outcome
Submitting a form or enquiry does not guarantee a match, a contract, or any specific commercial outcome. All matches are subject to Wattmatch's vetting process and the independent commercial agreement of both parties.
4. Marketplace fees
Wattmatch charges the fees described on our Pricing page, all exclusive of applicable taxes. Fees are disclosed before you are asked to pay them, at each stage of the tender process, and are never collected without your explicit action (e.g. clicking "Pay" at checkout).
5. Service delivery policy
Wattmatch's services are rendered as follows, immediately after the corresponding payment is confirmed:
- Bid Purchasing Fee: you are enrolled to accept the tender invitation and submit a bid immediately on payment confirmation. Tender documents themselves are freely available regardless of this payment.
- Bid Processing Fee: your technical and financial bid is accepted into the vetting queue immediately on payment confirmation.
- Earnest Money Deposit (EMD): this is a Bank Guarantee document you submit to us, not a payment — it is not covered by section 4 above at all. See our Refund & Cancellation Policy for when it is returned or invoked.
Where payment confirmation is delayed (e.g. a bank transfer still clearing), the corresponding service is rendered as soon as Wattmatch's systems receive confirmation from our payment processor, not from the time you initiated payment.
6. Acceptable use
You must not use, display, upload, modify, publish, transmit, update, share or store on Wattmatch any information that:
- belongs to another person and to which you do not have any right;
- is harmful, threatening, abusive, harassing, blasphemous, objectionable, defamatory, vulgar, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise unlawful in any manner;
- harms minors in any way;
- infringes any patent, trademark, copyright or other proprietary rights;
- violates any law for the time being in force;
- discloses sensitive personal information of another person, or information to which you do not have any right;
- causes annoyance or inconvenience, deceives or misleads the recipient about the origin of a message, or communicates any information that is grossly offensive or menacing in nature;
- impersonates another person;
- contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;
- threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence, prevents investigation of any offence, or insults any other nation.
7. Suspension and termination of access
If you do not comply with these terms of use or our Privacy Policy, Wattmatch has the right to immediately suspend or terminate your access to the Wattmatch e-procurement system.
8. Limitation of liability
Wattmatch facilitates matching and contract administration but is not liable for the performance, delivery, or conduct of any generator or C&I buyer under a matched agreement, except as expressly set out in the applicable PPA and escrow terms.
9. Grievance redressal
If you have a complaint about a transaction, a fee, or anything else related to your use of Wattmatch, you can reach our support team at hello@wattmatch.in. We acknowledge every complaint within 24 (twenty-four) hours of receiving it and resolve it within 15 (fifteen) days. If your complaint isn't resolved to your satisfaction within that time, you can escalate it to our Grievance Officer, Saumya Misra, by writing to saumya@wattmatch.in with the subject line "Grievance escalation" and your original complaint reference. The Grievance Officer will acknowledge the escalation within 24 (twenty-four) hours and resolve it within 15 (fifteen) days.
10. Designated agent for complaints and infringement notices
Complaints, grievances and notifications of claimed infringements (including of any content listed in section 6) should be sent to our designated agent and Grievance Officer: Saumya Misra, Grievance Officer, Wattmatch — saumya@wattmatch.in.
11. Governing law
These terms are governed by the laws of India, and the courts of New Delhi shall have exclusive jurisdiction over any dispute arising from them.
